I. Introduction

When you engage with VIP Pedicab, you entrust us with your personal data, and we are dedicated to upholding that trust. To begin, we aim to provide clarity regarding our privacy procedures.

This notification outlines the personal data ("data") we gather, its utilization and sharing, as well as your options concerning this data.

II. Overview

A. Scope

This notice pertains to users of the VIP Pedicab App and website.

This notice outlines the data collection and usage practices of VIP Pedicab and its affiliates. It applies to all VIP Pedicab users and specifically addresses:

Riders: individuals who request or receive transportation and related services.

Drivers: individuals who provide transportation to Riders individually.

All individuals covered by this notice are referred to as "users."

III. Data collections and uses

A. The data we collect

VIP Pedicab collects data: 

  1. provided by users 

  2. created during use of our services

  3. from other sources

User-Provided Data:

  • Account Information: We gather data when users create or update their VIP Pedicab accounts or place orders through guest checkout features. This encompasses first and last names, email addresses, phone numbers, login credentials, addresses, profile pictures, payment or banking details (along with related verification information), and  user preferences (including accessibility settings).

  • For drivers, this additionally includes vehicle or insurance details, emergency contact information, and proof of health or fitness to provide services using VIP Pedicab apps.

  • Background Check Information (Drivers): This consists of information submitted during the driver/delivery person application process, such as driving history or criminal records (where permitted by law), license statuses, known aliases, previous addresses, and right-to-work status. 

  • Identity Verification Documents and Photos: This entails government-issued identification documents such as driver’s licenses or passports (which may contain identification photos and numbers, dates of birth, and genders), as well as user-submitted photos like selfies and profile pictures.

  • Demographic Data: We collect demographic data like birth dates/ages, genders, or occupations when necessary to facilitate certain features or provide access to age-restricted products or services. Additionally, we collect or infer gender information (using first names) to allow female or non-binary users to specify their preference for providing or receiving services from female or non-binary users, and for marketing and advertising purposes.

Additionally, we collect demographic information such as age groups and household compositions through surveys completed by users.

User Content: We collect data (including chat logs and call recordings) when users reach out to VIP Pedicab customer support, provide ratings or feedback for users, utilize features enabling users to upload content or submit recordings (such as in-app audio recordings or dashboard camera recordings), or otherwise communicate with VIP Pedicab.

  1. Data Generated During Service Use:

  • Location Data (Drivers and Delivery Persons): We gather precise and approximate location data from drivers' and delivery persons' mobile devices when the VIP Pedicab app is active, whether in the foreground (app open and on-screen) or background (app open but not on-screen).

Location Data (Riders and Order Recipients): We collect precise and/or approximate location information from riders' and order recipients' mobile devices if they grant permission via their device settings.

VIP Pedicab collects such data from the moment a ride or order is requested until its completion, and whenever the app is in the foreground (app open and on-screen). Refer to the "Choice and Transparency" section below for details on how riders and order recipients can enable precise location data collection.

Riders and order recipients have the option to use the VIP Pedicab apps without enabling location data collection from their mobile devices. However, this may impact certain app features. For instance, a rider who hasn't enabled precise location data will need to manually enter their pickup address.

Furthermore, precise location data collected from a driver's device during a trip is associated with the rider's account, even if the rider hasn't enabled precise location data collection from their device. This data is utilized for purposes such as customer support, fraud detection, insurance, litigation, and receipt generation.

Transaction Information: We collect transaction details related to service usage, including the type of services requested or provided, trip or order specifics (like date and time, pickup and drop-off locations, distance traveled, and items ordered, such as food, prescription drugs, or other delivery items), and payment transaction specifics (such as restaurant or merchant names and locations, amount charged, and payment method). Additionally, we link a user's name with anyone using their promotion code.

This also encompasses information provided by users when placing orders, such as allergy information.

Usage Data: We gather information on how users engage with our services, including access dates and times, app features or pages viewed, browser types, and occurrences of app crashes and other system activities.

Device Data: We collect data concerning the devices utilized to access our services, including hardware models, device IP addresses or other unique identifiers, operating systems and versions, software, preferred languages, advertising identifiers, device motion data, and mobile network data.

Communications Data: We collect data pertaining to communications between users facilitated through VIP Pedicab's apps. This comprises communication types (phone calls, text messages, or in-app messages), date/time stamps, and content (including recordings of phone calls, provided users are informed of the recording in advance).

2. Safety, Fraud Protection, and Security. VIP Pedicab utilizes data to ensure the safety, security, and integrity of our services and users. This includes:

Account Verification: We conduct background checks on drivers and delivery persons to verify their identities and eligibility for providing transportation or deliveries. In certain regions, we also verify rider and order recipient identities using various personal information to prevent fraudulent account usage.

Identity and Age Verification: For transactions involving cash, alcohol or cannabis deliveries, or usage of specific VIP Pedicab services, we require user identity and/or age verification. This involves comparing user-submitted photos and government-issued identification to prevent misuse of accounts or creation of multiple accounts.

Safety Gear Verification: We use selfies to confirm users are wearing required safety gear, such as helmets, employing object verification technology for accuracy.

Detection of Unsafe Driving: By analyzing various data points, including customer service reports and device data, we identify potentially unsafe driving behaviors. This may lead to interventions to encourage safer driving or account deactivation.

Fraud Prevention and Detection: We analyze user data to prevent and detect fraudulent activities, including those by guest users.

Incident Reporting and Feedback: We utilize reported incidents and user feedback to maintain platform safety and compliance with our terms, taking action against users with low ratings.

User Pairing Prediction: Using driver and rider data, we predict and avoid pairings that may pose safety risks or conflicts.

These safety measures may involve profiling under applicable laws and may result in user deactivation after human review. For objections to these activities, please refer to the "Choice and Transparency" section below.

VIP Pedicab conducts these activities to fulfill our agreements with users and ensure the safety and security of our platform and its users.

3. Customer Support: VIP Pedicab utilizes the data we gather, including call recordings, chat logs, in-app audio recordings, and dashcam footage, to offer customer support. This includes investigating and resolving user concerns and enhancing our customer support responses and procedures.

VIP Pedicab conducts these activities to fulfill our agreements with users and for the legitimate interest of VIP Pedicab in enhancing its customer support services.

4. Facilitating communication between users. For instance, a driver may contact a rider to confirm a pick-up location, a rider may reach out to a driver regarding a lost item, or a restaurant or delivery person may communicate with an order recipient regarding their order.

VIP Pedicab engages in the aforementioned activities as they are essential for fulfilling the terms outlined in our agreements with users.

5. Marketing and Advertising. VIP Pedicab utilizes data (excluding guest users’ data) to promote its services.

We specifically utilize account details, approximate location, device and usage data, preferred language, trip and order history to deliver personalized ads and marketing communications based on users’ observed or inferred location, interests, and characteristics (which may include inferred gender*).

This includes utilizing this data to:

  • Send emails, text messages, push notifications, and in-app messages or other communications advertising VIP Pedicab products, services, features, offers, promotions, sweepstakes, news, and events. For instance, we may send push notifications suggesting users’ favorite destinations or merchants, or in-app messages offering discounts or promos for products or merchants similar to those previously ordered by users.

  • Display personalized advertising on third-party apps or websites.

  • Display third-party advertising in VIP Pedicab’s apps or in connection with our services. For instance, we display ads for restaurants or merchants available on VIP Pedicab’s apps. These ads (identified as “Sponsored Listings” in VIP Pedicab’s apps) include personalized recommendations based on users’ location and order histories.

  • Additionally, we display ads for third-party products not available on VIP Pedicab’s apps. These ads may contain links to third-party apps or websites. Users are encouraged to refer to such third parties’ privacy notices for information on their data collection and usage when visiting such apps or websites.

We also provide ads personalized based on data about users’ current trip or delivery request, including time of request and services requested. For example, if a user requests a trip to a supermarket, we may display in-app ads for third-party products available at that supermarket.

Furthermore, we measure the effectiveness of VIP Pedicab’s ads and third-party ads displayed in VIP Pedicab’s apps or in connection with our services.

VIP Pedicab conducts the above activities as they are necessary for the purposes of VIP Pedicab’s legitimate interests in informing users about VIP Pedicab services and features or those offered by VIP Pedicab partners. Refer to the sections titled “Choice and transparency” and “Marketing and advertising choices” for information on users’ choices regarding how VIP Pedicab may use their data for marketing and advertising.

6. Non-marketing communications. VIP Pedicab may utilize data to send surveys and other communications that are not intended for marketing VIP Pedicab's services or products, or those of its partners. Additionally, we may communicate with users regarding elections, ballots, referenda, and other political processes relevant to our services. For instance, VIP Pedicab has informed users about ballot measures or pending legislation concerning VIP Pedicab’s services in their respective areas.

VIP Pedicab engages in the above activities because they are necessary to fulfill the terms outlined in our agreements with users or for the legitimate interests of VIP Pedicab and its users in providing information about events that could impact their use of VIP Pedicab’s services.

7. Legal proceedings and requirements. We utilize data to investigate or address claims or disputes related to the use of VIP Pedicab’s services, to meet obligations under applicable laws, regulations, operating licenses or agreements, insurance policies, or in response to legal proceedings or governmental requests, including those from law enforcement agencies.

VIP Pedicab undertakes the above activities because they are necessary for VIP Pedicab’s legitimate interests in investigating and resolving claims and disputes related to the use of VIP Pedicab’s services and features, and/or to comply with applicable legal requirements.

C. Cookies and third-party technologies

VIP Pedicab and its partners utilize cookies and other identification technologies across our apps, websites, emails, and online advertisements for the purposes outlined in this notice and VIP Pedicab’s Cookie Notice.

Cookies are small text files stored on browsers or devices by websites, apps, online media, and advertisements. VIP Pedicab employs cookies and similar technologies for various purposes, including:

  • Authenticating users

  • Remembering user preferences and settings

  • Assessing the popularity of content

  • Delivering and evaluating the effectiveness of advertising campaigns

  • Analyzing site traffic and trends, and gaining insights into the online behaviors and interests of individuals interacting with our services

We may also authorize third parties to provide audience measurement and analytics services for us, to display advertisements on our behalf across the internet or for the products and services of other companies on our apps, and to monitor and report on the performance of these advertisements. These entities may utilize cookies, web beacons, SDKs, and other technologies to identify the devices used by visitors to our websites, as well as their activity on other online platforms and services.

D. Data sharing and disclosure

Certain services and functionalities offered by VIP Pedicab require the sharing of data with other users, either at the users' request or with their explicit consent. Additionally, we may share this data with our affiliates, subsidiaries, and partners for legal reasons or in connection with claims or disputes.

VIP Pedicab may share data in the following circumstances:

5. For legal reasons or in the event of a dispute

VIP Pedicab may share users’ data if deemed necessary by applicable law, regulation, operating license or agreement, legal process, governmental request, insurance policy, or where disclosure is otherwise warranted due to safety or similar concerns.

This may involve sharing data with law enforcement officials, public health authorities, other government entities, airports (if mandated by airport authorities as a condition of operating on airport premises), insurance companies, or other third parties as required to enforce our Terms of Service, user agreements, or other policies; to safeguard VIP Pedicab’s rights or property or the rights, safety, or property of others; or in the event of a claim or dispute concerning the use of our services. In situations involving disputes related to the use of another person’s credit card, we may be obligated by law to share a user’s data, including trip or order information, with the owner of that credit card.

6. With consent

VIP Pedicab may share a user’s data other than as outlined in this notice if we inform the user and they consent to the sharing.

E. Data retention and deletion

VIP Pedicab retains user data for as long as required for the purposes outlined above. Users have the option to request account deletion through the VIP Pedicab apps and websites.

VIP Pedicab retains user data for varying durations depending on factors such as data type, user category, purposes of data collection, and whether data retention is necessary after an account deletion request for the reasons described below.

For instance, we retain data:

- For the duration of users’ accounts if the data is essential for providing our services (e.g., account data).

- For 7 years if required to comply with tax regulations (e.g., drivers’ and delivery persons’ trip or delivery location information).

- For specified periods necessary for safety or fraud prevention purposes (e.g., incomplete driver applications retained for 1 year, and rejected driver applications retained for 7 years).

IV. Choice and transparency

VIP Pedicab empowers users to access and/or manage the data collected by VIP Pedicab through:

1. Privacy settings

Riders and order recipients can set or modify their preferences regarding location data collection and sharing, emergency data sharing, and notifications in VIP Pedicab’s App.

   - Location data collection (riders and order recipients)

   - Share Live Location (riders and order recipients)

   - Gender identity

      Riders can update their gender information through the Gender Identity menu, accessible in the Ads and Data menu in the Privacy Center.

    - Emergency Data Sharing

        Riders may enable VIP Pedicab’s sharing of their mobile device real-time location data with emergency police, fire, and ambulance services. This includes sharing approximate location at the time the emergency call was placed; the vehicle’s make, model, color, and license plate information; the rider’s name and phone number; pickup and drop-off locations; and the driver’s name.   

2. Device permissions

Most mobile device platforms (iOS, Android, etc.) have specified certain types of device data that apps cannot access without the device owner’s permission, and these platforms have varying methods for obtaining that permission. Users are encouraged to review the available settings on their devices or consult with their provider for further guidance.

C. Updates to this Privacy Notice

We may periodically update this notice. If significant changes are made, we will notify users in advance of the changes through the VIP Pedicab apps or via other means, such as email. We advise users to review this notice periodically for the latest information on our privacy practices.

Continued use of our services after an update constitutes consent to the updated notice to the extent permitted by law.
